Pepper Spray State Laws

The usage and shipping of pepper spray is regulated differently by each state.  Please make sure that you check your local state laws (we suggest doing a quick internet search on pepper spray laws in your state before completing your purchase on blingsting.com, as laws do frequently change). Most states do restrict the sale of pepper spray to minors, so please be sure you are over the age of 18 if you are purchasing or carrying a blingsting pepper spray.

While pepper spray is a non-lethal, positive self-defense product that is legal for use in all 50 states, some states do restrict the sale/shipping of pepper spray. 

The following information, while accurate at the time of posting, is by no means an official list of state regulations. Please check your state's official website for the most accurate information on pepper spray laws that may affect you. 

Alabama 

Pepper spray is legal in Alabama. It is legal to buy and carry pepper spray in Arizona with no restriction. It is also legal to ship pepper spray to Alabama.

Arizona 

Pepper spray is legal in Arizona.  It is legal to buy and carry pepper spray in Arizona with no restriction. It is also legal to ship pepper spray to Arizona. 

Arkansas 

Pepper spray is legal in Arkansas. It is legal to buy and carry pepper spray for the purpose of self-defense in Arkansas, however, the canister size cannot exceed 150 cc or 5.07 fluid ounces.

California

Pepper spray is legal in California as young as 16 with written parental permission. It is legal to buy and carry pepper spray for the purpose of self-defense in California, however, the canister size cannot exceed 2.5 ounces.

Colorado 

Pepper spray is legal in Colorado.  It is legal to buy and carry pepper spray in Colorado with no restriction. It is also legal to ship pepper spray to Colorado.  

Connecticut 

Pepper spray is legal in Connecticut.  It is legal to buy and carry pepper spray in Connecticut with no restriction. It is also legal to ship pepper spray to Connecticut.  

DC 

Pepper spray is legal in DC, as of November 2023 when the legislature removed the licensing requirement due to high crime rates. It is now legal to buy and carry pepper spray in DC with no restriction. It is also legal to ship pepper spray to DC. 

Delaware

Pepper spray is legal in Delaware.  It is legal to buy and carry pepper spray in Connecticut, for those over the age of 18. It is also legal to ship pepper spray to Delaware.

Pepper spray is legal in Florida. It is legal to buy and carry pepper spray in Florida, however, the canister size cannot exceed 2 ounces. It is also legal to ship pepper spray to Florida. 

Georgia

Pepper spray is legal in Georgia. It is legal to buy and carry pepper spray in Georgia. It is also legal to ship pepper spray to Georgia. 

Hawaii 

Pepper spray is legal in Hawaii. It is legal to buy and carry pepper spray in Hawaii, however, the purchaser must be over the age of 18 and have no felony convictions. Pepper spray cannot be shipped to Hawaii.

Pepper spray is legal in Idaho. It is legal to buy and carry pepper spray in Idaho. It is also legal to ship pepper spray to Idaho. 

Illinois

Pepper spray is legal in Illinois. It is legal to buy and carry pepper spray in Illinois, however you must be 18 years of age or older to purchase. It is also legal to ship pepper spray to Illinois.

Indiana 

Pepper spray is legal in Indiana. It is legal to buy and carry pepper spray in Indiana. It is also legal to ship pepper spray to Indiana.  

Iowa

Pepper spray is legal in Iowa. It is legal to buy and carry pepper spray in Iowa. It is also legal to ship pepper spray to Iowa.

Louisiana

Pepper spray is legal in Louisiana.  It is legal to buy and carry pepper spray in Louisiana. It is also legal to ship pepper spray to Louisiana.

Maine 

Pepper spray is legal in Maine. It is legal to buy and carry pepper spray in Maine, for the use of self-defense only. It is also legal to ship pepper spray to Maine. 

Maryland

Pepper spray is legal in Maryland. It is legal to buy and carry pepper spray in Maryland. It is also legal to ship pepper spray to Maryland. 

Massachusetts

Pepper spray is legal in Massachusetts, with restrictions. It is legal to buy and carry pepper spray in Massachusetts, for those who have not been convicted of a felony, violent crime, or have been committed to a hospital or mental institution. It is not legal to ship pepper spray into the state. 

Michigan

Pepper spray is legal in Michigan, with restrictions. It is legal to buy and carry pepper spray in Michigan, as long as the formulation does not contain more than 18% OC. Canisters cannot exceed 1.2 ounces. You must also be 18 years of age to carry or purchase.  It is also legal to ship pepper spray to Michigan.

Pepper spray is legal in Minnesota. It is legal to buy and carry pepper spray in Minnesota, for those over 16 years of age. It is also legal to ship pepper spray to Maryland.

Mississippi 

Pepper spray is legal in Mississippi. It is legal to buy and carry pepper spray in Mississippi. It is also legal to ship pepper spray to Mississippi. 

Missouri

Pepper spray is legal in Missouri. It is legal to buy and carry pepper spray in Missouri.  It is also legal to ship pepper spray to Missouri. 

Montana 

Pepper spray is legal in Montana. It is legal to buy and carry pepper spray in Montana. It is also legal to ship pepper spray to Montana.

Nebraska 

Pepper spray is legal in Nebraska. It is legal to buy and carry pepper spray in Nebraska.  It is also legal to ship pepper spray to Nebraska. 

Nevada 

Pepper spray is legal in Nevada. It is legal to buy and carry pepper spray in Nevada, with restrictions. Canisters cannot exceed 2 ounces, and possession by minors is illegal. It is also legal to ship pepper spray to Nevada. 

New Hampshire 

Pepper spray is legal in New Hampshire. It is legal to buy and carry pepper spray in New Hampshire.  It is also legal to ship pepper spray to New Hampshire.

New Jersey 

Pepper spray is legal in New Jersey. It is legal to buy and carry pepper spray in New Jersey, as long as the canister size does not exceed ¾ oz. It is also legal to ship pepper spray to New Jersey. 

New Mexico 

Pepper spray is legal in New Mexico. It is legal to buy and carry pepper spray in New Mexico.  It is also legal to ship pepper spray to New Mexico.

New York 

Pepper spray is legal in New York. It is legal to buy and carry pepper spray in New York, with several restrictions. Those who are 18 years and older, and have not been convicted of a felony or assault, may purchase pepper spray. It is not legal to ship pepper spray to New York. 

North Carolina 

Pepper spray is legal in North Carolina. It is legal to buy and carry pepper spray in North Carolina, with restrictions.  Canister size cannot exceed 1.7 ounces, and convicted felons may not purchase. It is also legal to ship pepper spray to North Carolina.

North Dakota 

Pepper spray is legal in North Dakota.  It is legal to buy and carry pepper spray in North Dakota.  It is also legal to ship pepper spray to North Dakota. 

Ohio 

Pepper spray is legal in Ohio. It is legal to buy and carry pepper spray in Ohio. It is also legal to ship pepper spray to Ohio. 

Oklahoma 

Pepper spray is legal in Oklahoma. It is legal to buy and carry pepper spray in Oklahoma.  It is also legal to ship pepper spray to Oklahoma.

Oregon 

Pepper spray is legal in Oregon. It is legal to buy and carry pepper spray in Oregon.  It is also legal to ship pepper spray to Oregon.

Pennsylvania

Pepper spray is legal in Pennsylvania. It is legal to buy and carry pepper spray in Pennsylvania. It is also legal to ship pepper spray to Pennsylvania.

Rhode Island

South Carolina 

Pepper spray is legal in South Carolina. It is legal to buy and carry pepper spray in North Carolina, as long as the canister size does not exceed 1.69 ounces. It is also legal to ship pepper spray to South Carolina.

South Dakota 

Pepper spray is legal in South Dakota. It is legal to buy and carry pepper spray in South Dakota. It is also legal to ship pepper spray to South Dakota.

Tennessee 

Pepper spray is legal in Tennessee.  It is legal to buy and carry pepper spray in Tennessee. It is also legal to ship pepper spray to Tennessee.

Texas 

Pepper spray is legal in Texas. It is legal to buy and carry pepper spray in Texas. It is also legal to ship pepper spray to Texas.

Utah

Pepper spray is legal in Wisconsin. It is legal to buy and carry pepper spray in Wisconsin, with restrictions. Pepper spray cannot be disguised, contain UV dye, or exceed 2 ounces. You must be 18 years of age or older to purchase and possess. It is also legal to ship pepper spray to Wisconsin.
